Please read these Terms and Conditions carefully before using the Service.

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms and Conditions.

These Terms apply to all visitors, Users, and others who access or use the Service.

Glossary

Service – IQ Hashtags page and its solutions.
Terms and Conditions, Terms – terms and conditions of service (including refund and complaints policy): Terms and Conditions.
Registration – takes place after selecting the registration button on the IQ Hashtags platform and requires the New User to provide an e-mail address and password and read and accept the Terms and Conditions, containing the regulations for the provision and use of services.
Start using the service – starting the Trial Period, logging in to the service after starting a paid Subscription, and logging in to the service after the automatic renewal of the subscription.
Account – user account (inactive, trial, or paid).
Profile – an Instagram profile.
Test period – 3 days during which the New User can test all service features free of charge.
Subscription – a model of an automatically renewed monthly or yearly license to use the software.
Plan – Trial, Starter, Growth, Pro, and Enterprise.
Price list – plans in IQ Hashtags with a list of the solutions included in each plan and the price.
User – all platform’s users (Customer + New user).
New user – a person who has registered a new account on the platform and/or has never used the paid version of the tool.
Customer – a person who currently uses or has used in the past a paid version of the platform.
Payment – fee for the use of the service.
Invoice – automatically issued invoices in the tool, which also confirms payment.
Payment method – the payment method that the user enters into the tool to pay for the use of the platform.
Plan duration – the prepaid period in the tool – month or year.
Renewal (subscription; automatic) – automatic subscription renewal for the next period, according to the plan chosen by the user (monthly or yearly). Automatic renewals are any subscription payments made after the first month or the first year, respectively.
Convert to subscription – convert the trial period into a paid subscription.
Canceling the trial period – terminating the trial period in the Account Settings
Canceling active Subscription – terminating active subscription in the Account Settings by the Customer before the subscription renewal for the new period (no later than the last day of the ongoing plan).
Refund – the return of the service fee (refund conditions are included in the Terms and Conditions).
Account removal – complete removal of the account and its data from the platform.

Terms of Use

By using or accessing our website and Services, you understand and agree to be bound by the Terms and Conditions outlined on the website.

By using or accessing our website and Services, you acknowledge that you have read and understand these Terms and agree to comply with them fully.

By concluding the contract on behalf of another legal person and its entities, you declare that you are authorized to complete the agreement on its behalf.

You also declare that you are responsible for compliance with the agreement and its provisions and entirely accountable for the accepted Terms and Conditions of the Service.

Instagram Captions: Create automated, tailored captions for your Instagram posts and Reels
AI Assistant: Get creative ideas for new posts on your profile
Content Recycling: Refresh your old posts and reuse their new versions in your communication
Hashtag Collections: Create easy-to-copy hashtag collections
Followers Analysis: Get to know your audience and discover the best times to post on Instagram
Trending Songs: Discover the currently trending music on Instagram that is gaining popularity
Content Analysis: Analyze all types of your posts and their statistics in one place
Search Hashtags: Search for hashtags on Instagram and view their statistics
Banned Hashtags: Identify banned hashtags on Instagram, including those already used in your profile
Profile Analysis: Analyze your profile statistics, including banned hashtags in your posts
Reels Metrics: Analyze statistics of your posts and Reels

All solutions are available to users during the 3-day Trial Period and after purchasing a Paid Subscription.

Some features require authorization of your Instagram profile and associated Facebook page.

The Instagram profile must meet the following criteria:

The Profile must be public on Instagram.
The Profile must have a professional status, either as a business account or a creator account.
The Profile must be linked to a Facebook page (it cannot be linked to a personal Facebook profile).
The User must have access to the Facebook page linked to the Instagram profile.
The User must have Administrator-level access (either full or partial control) to the Facebook page linked to the Instagram profile.

Without profile authorization, the User will not be able to access some features, including Hashtags Performance, Content Recycling, Content Analysis, Reels Metrics, Profile Analysis, Followers Analysis, and TOP9.

Other features of the service do not require Instagram profile authorization.

We are not responsible for interruptions in the performance of the Service or specific features if the interruption is beyond our control (e.g., issues with third-party tool partners, or actions on Instagram).

IQ Hashtags is the sole owner of the Service and its tools, with full rights to manage and use the solutions as we deem appropriate.

You agree not to reproduce, duplicate, copy, sell, barter, or resell the Services for any purpose.

You agree not to reproduce, duplicate, copy, sell, barter, or resell the Services for any purpose. You also agree not to obscure, remove, or alter proprietary rights, trademarks, logos, copyright notices, or any other indications of IQ Hashtags’ ownership.

Additionally, you agree not to copy, modify, distribute, or create derivative works based on the Service or its content. You further agree not to attempt to discover the software’s source code or any proprietary data, nor to assist others in doing so.

By using or accessing the Service, you acknowledge and agree to these Terms.

Accounts

When you create an Account with us, you must provide us with accurate, complete, and current information.

You are responsible for safeguarding your password to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your Account.

The service is not responsible for how the User uses the tool and Service.

Conditions for analyzing a Profile in IQ Hashtags:

You can analyze as many Profiles as your Plan allows.
You can check the number of Profiles in each Plan in the Price List.
If you need to analyze more Profiles, you can upgrade your Plan to a higher one.
It is not possible to analyze a private Profile.
It is not possible to analyze a personal Profile. Your Profile must have the status of a professional account on Instagram – a business account or a creator account.
It is only possible to analyze a Profile linked to a Facebook page. Therefore, your Instagram Profile must be linked to a Facebook page (your Instagram Profile cannot be linked to a private Facebook profile).

Subscription and Trial period

IQ Hashtags Subscription is preceded by the Trial period available only to New users.

All new Users can test all features for 3 days.

1. Trial period – New user

The IQ Hashtags Trial period lasts 3 days, during which New users can test the STARTER, GROWTH, PRO, or ENTERPRISE Plan.

To start the Trial period in the tool, the new User must:

2. First, Register an Account on the IQ Hashtags platform and accept the Service Terms and Conditions.

The trial period ends after 3 days, and your account will become inactive. You should choose and start a paid subscription to regain access to the service’s features.

The free 3-day trial is available only to users who have never previously used the paid version of the service.

The start of the Trial Period does not oblige the User to start a paid Subscription.

3. Subscription – Customer

IQ Hashtags Subscription has two forms: monthly and annual.

Monthly Subscriptions are automatically renewed every month until canceling the Plan by the User.
Annual Subscriptions are automatically renewed every year until canceling the Plan by the User. In case the Annual Subscription is selected, the User receives a loyalty discount in line with the deal visible in the Pricing list for annual periods, allowing him/her to use the tool at a lower price than if he/she regularly renews the Plan every month. The yearly Subscription fee is charged in advance for the entire period.

IQ Hashtags Subscription is renewed automatically according to the Plan selected by the user.

It allows the use of paid features of the tool for a specified period (month or year).

You can cancel your Subscription at any time in your Account Settings.

If the Customer is unwilling to continue using the paid version of the tool, he/she is obliged to terminate his/her Plan in the Account Settings. The Subscription must be canceled before the Plan automatically Renews for the next period. The date and time of the Subscription Renewal can be checked at any time in the User’s Account Settings under the Subscription section. For PayPal Payments, you need to delete the Subscription in your PayPal account for Payments.
If the User cancels the Subscription, the Subscription will not be renewed for the next period. Therefore, the data will cease to be collected and available to the User after the end of the active paid Subscription period in the tool.
If the User decides to keep an active Subscription, the Plan is automatically renewed following the chosen Subscription Plan and its Renewal period.

4. Trial period and Subscription – Plan contents

During the Trial Period, the New User may test paid IQ Hashtags features for 3 days free of charge and analyze their Account data corresponding to the contents of the Plans of Customers with active paid Subscriptions.

The paid Plans in IQ Hashtags consist of features listed under the Price list, which include the following:

Shadowban
Hashtag Performance
Hashtags Suggestions
Hashtag Collections
AI Assistant
Content Analysis
Instagram Captions
Content Recycling
Profile Analysis
Followers Analysis
Reels Metrics
Banned Hashtags
Trending Songs

Users cannot request Instagram Audit during the trial period, as it is only available to paid users with the PRO or ENTERPRISE plans.

No email notification is sent either about the ending Trial Period or the upcoming Subscription Renewal date.

By using or accessing our Service, you understand and accept these Terms.

IQ Hashtags account removal

Users on a Trial Period can delete their account through the settings in their IQ Hashtags Account.

Users with an active Paid Subscription who wish to delete their Account must contact us via email at: [email protected]

Removing the Account during the prepaid Subscription period does not entitle the user to a Refund for the unused time.

Terms of refunds and complaints

The User must read the Service Terms and Conditions containing regulations for Refunds and complaints when Registering an account.

Marking the “I accept the regulations and privacy policy” field is tantamount to a declaration that the User has read the Services’ Terms and Conditions and agrees to comply with the provisions contained therein, including the following regarding Refunds and complaints.

To submit a request for a Refund, the User should contact the Service by sending an e-mail to [email protected] and provide the necessary information about the Account and Subscription and the reasons for which he/she expects a Refund.

By filling in and submitting the Refund Request, you are not guaranteed to receive a refund of a Service Fee.

1. Monthly and annual subscriptions – Refund Policy

Applies to the first month and year of subscription in the tool or the renewal of the plan for the following month or year:

Monthly and Annual plans that start during or after the end of the free 3-day trial period are non-refundable.

The User has the opportunity to test the tool for 3 days before deciding to purchase.

To start a Paid Plan, the User must consciously select the ‘Subscribe’ or ‘Complete the payment’ option, then choose the desired Plan, enter their card details, and finally confirm the Payment.

If the User chooses to buy the Subscription during or after the 3-day Trial, it is considered that the User has voluntarily and knowingly purchased the Plan for the following month or year (depending on the chosen plan).

Monthly and Annual automatic Subscription Renewals that the User has not canceled during the active paid Subscription are not Refundable.

Automatic Renewals are defined as any Subscription payment made after the first month or year, depending on the User’s chosen Plan.

You can find information on troubleshooting your account and instructions for canceling your subscription in the service’s Help Desk and the ‘Help’ section of your account.

2. Other cases – Refund Policy

You may be entitled to a refund if you have encountered technical issues while using IQ Hashtags.

The right to a Refund and the amount will be determined individually after verification of the request.

Please send us a message with a description of the problem ([email protected]), and we will take appropriate action.

The following situations are not subject to Refund:

If you canceled and then restarted/resumed your subscription.
Problems resulting from the temporary unavailability of META (Instagram) API, which may affect the downloading of the User’s Account data.
Problems resulting from the User’s actions that may prevent the downloading of the data and the use of the tool (including but not limited to disabling Profile authorization via Facebook, removing the link between the Instagram Profile and the Facebook page, disabling the professional Account in the Instagram Profile).
Requests where the User voluntarily and knowingly never began or ceased using selected features of the service by not granting or by revoking Authorization of their Instagram profile.
Expired claims, i.e., claims that exceed the time specified in the Terms and Conditions in which we can accept your claims (go back to the Monthly Subscriptions and Annual Subscriptions section for more details).
Requests made more than a year after the last Payment,
Requests where the User claims to have experienced technical issues preventing them from using the Platform throughout the entire period, but never reported these issues to the Service while they were occurring.
Requests where the User claims not to have used the Service or to have used it infrequently— we are not responsible for how Users utilize the Service or the frequency of their usage.
The Service is not responsible for failing to cancel a subscription started with PayPal. Subscriptions initiated via PayPal are non-refundable.
Other situations not described in the Terms and Conditions are independent of the website, e.g., server downtime (external provider).

All refund requests are verified using, among other things, user activity logs from the IQ Hashtags platform and payment services used on the site. These logs include data such as login times, visits to specific tabs, and the use of the subscription cancellation button. By using or accessing our Service, you understand and accept these Terms.

Fee Changes

Ailo sp. z o.o., in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

Ailo sp. z o.o. will provide you with reasonable prior notice of any change in Subscription fees to allow you to terminate your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

Chargeback

If Subscription fees are challenged at a company that supports your credit card or your financial institution, and if the Ailo investigation leads to the conclusion that the fees were justified, we may, with reasonable notice in advance, charge your Account a justified amount required to represent the cost of responding to your chargeback Refund request.

Invoices and confirmations

We do not issue manual Invoices at the Customer’s request.

IQ Hashtags Invoices are issued automatically based on the Customer’s company data entered.

Entering data for invoicing is mandatory for Users who wish to receive an Invoice for their purchase.

For New Users starting a Trial Period with the tool, the User is not required to fill in the invoice details immediately. However, this must be done no later than during the process of making the first Payment if the User decides to continue with a Paid Subscription after the Trial period.

Users for whom the Trial Period does not apply (those who have used paid Plans in the past and/or are renewing the Subscription) are required to provide their information immediately during the process of making the Payment for the Subscription.

Customers who do not enter their company information within the specified time frame will receive an automatic invoice in the tool without their company details.

The automatic Invoice also confirms the purchase in the tool; no other confirmation is required.

Other situations will be considered individually after sending a request to [email protected], provided that the time from the Payment to the application does not exceed 30 days.

It is not possible to issue a new invoice or change the details on the invoice after this period has passed.

By using or accessing our Service, you understand and accept these Terms.

Marketing & Newsletter

By Registering an Account with IQ Hashtags, you agree to receive emails, including newsletters, product updates, start-up news, invitations to webinars, or any other messages we deem relevant and important.

You may unsubscribe from any of these by using the “Unsubscribe” button in each message.

You agree that the deletion of your Account and data from the Service or the termination of your Subscription to the Service does not imply the termination of the marketing agreement.

Therefore, you agree to receive messages even if you have deleted or terminated your Account and Subscription.

Suppose you no longer consent to receive emails from IQ Hashtags.

In that case, you are responsible for removing yourself from this mailing list by clicking the “Unsubscribe” button in the email you receive and agreeing to do so yourself.

Governing Law

These Terms shall be governed and construed following the laws of Poland, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we have between us regarding the Service.

According to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on the online consumer dispute resolution system and amendments to Regulation (EC) No 2006/2004 and Directive 2009/22 / EC (Regulation on the ODR in consumer disputes).
