Terms and Conditions

These Terms and Conditions („Terms,” „Terms and Conditions”) govern your relationship with www.iqhashtags.com website (the „Service”) operated by Ailo sp. z o.o. , Kordiana 31/51, 30653 Krakow, Poland, KRS0000368886, REGON 121376183, NIP 6762430848 („us”, „we”, or „our”).

Please read these Terms and Conditions carefully before using the Service.

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms and Conditions. 

These Terms apply to all visitors, Users, and others who access or use the Service.


  1. Service – IQ Hashtags page and its solutions.
  2. Terms and Conditions, Terms – terms and conditions of service (including refund and complaints policy): Terms and Conditions.
  3. Registration – takes place after selecting the registration button on the IQ Hashtags platform and requires the New User to provide an e-mail address and password and read and accept the Terms and Conditions, containing the regulations for the provision and use of services.
  4. Starting using the service – starting the Trial Period, logging in to the service after starting a paid Subscription, and logging in to the service after the automatic renewal of the subscription.
  5. Account – user account (inactive, trial, or paid).
  6. Profile – an Instagram profile.
  7. Test period – a period of 7 days during which the New User can test all service features free of charge.
  8. Subscription – a model of an automatically renewed monthly or yearly license to use the software.
  9. Plan – Trial, Starter, Growth, Pro, and Enterprise.
  10. Price list – plans in IQ Hashtags with a list of the solutions included in each plan and the price.
  11. User – all platform’s users (Customer + New user).
  12. New user – a person who has registered a new account on the platform and/or has never used the paid version of the tool.
  13. Customer – a person who currently uses or has used in the past a paid version of the platform.
  14. Payment – fee for the use of the service.
  15. Invoice – automatically issued invoices in the tool, which also confirm payment.
  16. Payment method – the payment method that the user enters into the tool to pay for the use of the platform.
  17. Plan duration – the prepaid period in the tool – month or year.
  18. Renewal (subscription; automatic) – automatic subscription renewal for the next period, according to the plan chosen by the user (monthly or yearly). Automatic renewals are any subscription payments made after the first month or the first year, respectively.
  19. Convert to subscription – convert the trial period into a paid subscription.
  20. Canceling the trial period – terminating the trial period in the Account Settings by the New User before the end of the trial period (not later than the 7th day of the trial period).
  21. Canceling active Subscription – terminating active subscription in the Account Settings by the Customer before the subscription renewal for the new period (no later than the last day of the ongoing plan).
  22. Refund – the return of the service fee (refund conditions are included in the Terms and Conditions).
  23. Account removal – complete removal of the account and its data from the platform.

Terms of Use

By using or accessing our website and Services, you understand and agree to be bound by the Terms and Conditions contained in the website.

By using or accessing our website and Services, you acknowledge that you have read and understand these Terms and agree to comply with them fully.

By concluding the contract on behalf of another legal person and its entities, you declare that you are authorized to complete the agreement on its behalf.

You also declare that you are responsible for compliance with the agreement and its provisions and entirely accountable for the accepted Terms and Conditions of the Service.


Our tool is used for the following:

  1. search for hashtags on Instagram,
  2. analyzing the performance of hashtags used in a post on Instagram,
  3. recognizing banned hashtags, including banned hashtags used in a Profile,
  4. creating collections of hashtags,
  5. analyze statistics of posts and reels on Instagram,
  6. checking the best hours for publications on Instagram,
  7. creating descriptions for posts and reels on Instagram,
  8. analyzing publicly available accounts on Instagram.

Our platform allows to:

Analyze Profiles and content: (remember, you must have access to the Profile and authorize it with Facebook)

  1. analyze any public Profile to track the performance of its content,
  2. analyze any public Profile and its audience to discover active followers and non-followers of that Profile,
  3. analyze any public Profile and its content to find and list all banned hashtags (blocked, prohibited) in that Profile,
  4. analyze any public Profile and its content to find and list all hashtags used in that Profile,
  5. analyze any public Profile and its content to find and list all unique hashtags in that Profile,
  6. analyze the Profile’s audience – their gender, where they are from, and their age,
  7. analyze the best publication hours for any public Profile,
  8. analyze reels statistics for any public Profile.

Analyze, search, and create hashtag collections:

  1. analyze any hashtags if they have been banned (blocked, banned) on Instagram,
  2. search hashtags by topic and size, among others, 
  3. search trending hashtags related to the selected topic.

We are not responsible for interruptions in the performance of the Service or selected solutions in case the interruption is not dependent on us (tool partners, other activities on Instagram).

IQ Hashtags is the only owner of the Service and its tools, with full rights to dispose of the solutions and how to use them.

You agree not to reproduce, duplicate, copy, sell, barter, or resell the Services for any purpose.

You also agree not to obscure, remove or alter proprietary rights, trademarks, logos, related notices, or other notices of IQ Hashtags’ proprietary rights.

You agree not to copy, modify, distribute, or create derivative works based on the Service or content.

You agree not to attempt or assist others in discovering the software’s source code or any know-how data.

By using or accessing the Service, you understand and agree to these Terms.


When you create an Account with us, you must provide us with accurate, complete, and current information.

You are responsible for safeguarding your password to access the Service and for any activities or actions under your password, whether your password is with our Service or a third-party service.

You agree not to disclose your password to any third party.

You must notify us immediately upon becoming aware of any breach of security or unauthorized use of your Account.

The service is not responsible for how the User uses the tool and Service.

Conditions for analyzing a Profile in IQ Hashtags:

  1. You can analyze as many Profiles as your Plan allows. 
  2. You can check the number of Profiles in each Plan in the Price List.
  3. If you need to analyze more Profiles, you can upgrade your Plan to a higher one.
  4. It is not possible to analyze a Profile that is private or has an age restriction.
  5. It is not possible to analyze a personal Profile. Your Profile must have the status of a professional account on Instagram – a business account or a creator account.
  6. It is only possible to analyze a Profile linked to a Facebook page. Therefore, your Instagram Profile must be linked to a Facebook page (your Instagram Profile cannot be linked to a private Facebook profile).

By using or accessing our Service, you understand and accept these Terms.

Subscription and Trial period

IQ Hashtags Subscription is preceded by the Trial period available only to New users.

  1. Trial period – New user

The IQ Hashtags Trial period lasts 7 days, during which New users can test the STARTER, GROWTH, PRO, or ENTERPRISE Plan.

To start the Trial period in the tool, the new User must:

  1. First, Register an Account on the IQ Hashtags platform and accept the Service Terms and Conditions.
  2. Choose the Plan they are interested in – STARTER, GROWTH, PRO, or ENTERPRISE and Plan duration – min. 1 month or 1 year.
  3. Enter Payment Method (Credit Card, Apple Pay, Google Pay)

During the Trial Period, which lasts 7 days, the user may decide to continue the selected Plan under the paid Subscription or resign from continuing the Plan under the paid Subscription before the end of the Trial Period.

If the New User is unwilling to use the paid version of the Service, he/she is obliged to terminate his/her Plan on his/her own no later than the last day of the Trial Period. You may end your Plan in your Account Settings.

In the absence of action on the part of the User to end the Trial Period (the user did not cancel his Plan in the Account Settings before the end of the last day of the Trial Period), the Trial Period is automatically converted into a paid Subscription, for which a fee is charged in accordance with the Price List and the value of the Plan, which was selected by the User at the start of the Trial Period on the platform. This information is available to the User in configuring the Trial Period and in the Platform terms and conditions, which the User must read and accept during Account Registration and in Account Settings.

During the Trial Period, the User may change his Plan if he would like to use a lower or higher Plan than the one he had selected during Registration. The start of the Trial Period does not oblige the User to start a paid Subscription; however, the User who does not want to start the paid Subscription is obliged to cancel the Trial Period before the end of the 7-day Trial Period in the Settings of his account. Therefore, lack of action (canceling the Plan) before the end of the Trial Period is tantamount to the consent to start a paid Subscription for the tool.

Users who have used the paid version of the platform in the past, after choosing a Plan and entering the Payment Method, are not eligible for Trial Period, and a paid Subscription automatically starts.

By using or accessing our Service, you understand and accept these Terms.

  1. Subscription – Customer

IQ Hashtags Subscription has two forms: monthly and annual.

  1. Monthly Subscriptions are automatically renewed every month until canceling the Plan by the User.
  2. Annual Subscriptions are automatically renewed every year until canceling the Plan by the User. In case the Annual Subscription is selected, the User receives a loyalty discount in line with the deal visible in the Pricing list for annual periods, allowing him/her to use the tool at a lower price than if he/she regularly renews the Plan every month. The yearly Subscription fee is charged in advance for the entire period.

IQ Hashtags Subscription is renewed automatically according to the Plan selected by the user. 

It allows the use of paid features of the tool for a specified period (month or year).

You can cancel your Subscription at any time in your Account Settings.

  1. If the Customer is unwilling to continue using the paid version of the tool, he/she is obliged to terminate his/her Plan in the Account Settings. The Subscription must be canceled before the Plan automatically Renews for the next period. The date and time of the Subscription Renewal can be checked at any time in the User’s Account Settings under the Subscription section. For PayPal Payments, you need to delete the Subscription in your PayPal account for Payments.
  2. If the User cancels the Subscription, the Subscription will not be renewed for the next period. Therefore, the data will cease to be collected and available to the User after the end of the active paid Subscription period in the tool.
  3. If the User decides to keep an active Subscription, the Plan is automatically renewed in accordance with the chosen subscription Plan and its Renewal period. This information is available to the User in configuring the Trial Period and in the Platform Terms and Conditions, which the User must read and accept during Registration and in User Account Settings.

By using or accessing our Service, you understand and accept these Terms.

  1. Trial period and Subscription – Plan contents

During the Trial Period, the New User may test paid IQ Hashtags features for 7 days free of charge and analyze their Account data corresponding to the contents of the Plans of Customers with active paid Subscriptions.

The paid Plans in IQ Hashtags consist of features listed under the Price list, which include the following:

  1. Search hashtags
  2. Hashtag performance
  3. Hashtag collections
  4. Profile analysis
  5. Followers analysis
  6. Reels metrics
  7. Banned hashtags

During the Trial Period, the User is not eligible to have the individual Instagram account audit performed that is available to paid Subscriptions Customers with an active paid Subscription using the PRO or ENTERPRISE Plan.

No e-mail notification is sent either about the ending Trial Period or the upcoming Subscription Renewal date.

By using or accessing our Service, you understand and accept these Terms.

IQ Hashtags account removal

Each User may submit a request to remove the Account and its data from the platform by sending an email to [email protected] or via chat (the service is available to the Customers of the tool, i.e., people with an active paid Subscription).

In the application’s content, the User should include the necessary information, such as the e-mail address associated with the registered Account.

If he/she is unsure which e-mail address he/she uses, he/she should attach Instagram Profiles that he/she analyzes in his/her Account to facilitate verification and finding his/her Account in the system.

Before removing the Account, Users with an active Trial Period or an active paid Subscription are required to cancel each of them in the Settings of their Account.

For PayPal Payments, you need to delete the Subscription in your PayPal account.

Removing an Account with an active Subscription or an active Trial Period is impossible.

Removing the Account during the prepaid period for the Subscription does not imply a Refund for the unused time by the User.

Terms of refunds and complaints

The User must read the Service Terms and Conditions containing regulations for Refunds and complaints when Registering an account.

Marking the “I accept the regulations and privacy policy” field is tantamount to a declaration that the User has read the Services’ Terms and Conditions and agrees to comply with the provisions contained therein, including the following regarding Refunds and complaints.

To submit a request for a Refund, the User should contact the Service by sending an e-mail to [email protected] or via chat and provide the necessary information about the Account and Subscription, as well as the reasons for which he/she expects a Refund.

By using or accessing our Service, you understand and accept these Terms.

  1. Monthly subscriptions – refunds

Monthly automatic Subscription Renewals that the User has not canceled during the active paid Subscription are not Refundable.

Automatic Renewals are defined as any Subscription payment made after the first month or year, depending on the User’s chosen Plan.

By using or accessing our Service, you understand and accept these Terms.

  1. Trial period – refunds

The only exception to Refunds for Monthly Subscriptions is during the Trial Period.

If, after the Trial Period, the User starts a monthly, paid Subscription and requests a Refund up to 3 days after the Payment was collected from his/her Account, the Refund will be accepted.

Application forms requested after 3 days of active Subscription will only be considered in exceptional circumstances.

In the case of an Annual Subscription started after the Trial Period, the Refund conditions are the same as the conditions for Annual Subscriptions for other Customers, which you can read about below.

By using or accessing our Service, you understand and accept these Terms.

  1. Annual subscriptions – refunds

We offer a full Refund for the annual Subscription for applications sent to us no later than 3 days from the date of Payment and automatic Invoice issuance in the case of automatic Subscription Renewals, as well as starting a new Subscription after the end of the Trial Period.

In the case of applications sent after 3 days of Payment but within 14 days after the Payment, we offer a partial Refund for the remaining unused months of the Subscription.

The partial Refund amount is calculated according to the formula: the amount charged for the annual Subscription with a loyalty discount is reduced by the Plan’s monthly value without the discount.

By using or accessing our Service, you understand and accept these Terms.

  1. Other cases

You may be entitled to a refund if you have encountered technical issues while using IQ Hashtags.

The right to a Refund and the amount will be determined individually after verification of the request.

Please send us a message with a description of the problem ([email protected] or via chat), and we will take appropriate action.

The following situations are not subject to Refund:

  1. Problems resulting from the temporary unavailability of META (Instagram) API, which may affect the downloading of the User’s Account data.
  2. Problems resulting from the User’s actions that may prevent the downloading of the data and the use of the tool (including but not limited to disabling Profile authorization via Facebook, removing the link between the Instagram Profile and the Facebook page, disabling the professional Account in the Instagram Profile).
  3. Expired claims, i.e., claims that exceed the time specified in the Terms and Conditions in which we can accept your claims (go back to the Monthly Subscriptions and Annual Subscriptions section for more details).
  4. The Service is not responsible for not canceling the Subscription started with PayPal. It is also non-refundable.
  5. Other situations not described in the Terms and Conditions are independent of the website, e.g., downtime of servers (external provider).

By using or accessing our Service, you understand and accept these Terms.

  1. Verification of applications and legal notes

Each disputed situation in connection with the complaint and refunds considered individually is subject to verification by the Support team each time based on:

  1. Platform Terms and Conditions and compliance of claims with respect to the contained records.
  2. Content of the User’s message.
  3. Logs of the User’s Account on the platform and a record of his/her activity.
  4. Logs of Payment systems for a given User used by IQ Hashtags – Stripe, Chargebee.

The User’s Account logs contain accurate information about the dates and times of each login, visited tabs of the tool, buttons pressed and started, and unfinished processes, including closing the active Subscription.

The law regulates the conditions of returns in force in the European Union and outside the EU:

  1. Global refunds policy: “(…) digital products can’t usually be returned, as they are downloadable, licensed, or accessed on a subscription basis.”
  2. European law and refunds policy: “online digital content, if you have already started downloading or streaming it and you agreed that you would lose your right of withdrawal by starting the performance.”

Purchased digital products based on the Subscription billing model are not eligible for Refund within 14 days.

Starting to use the platform is tantamount to using the purchased product.

When resolving disputes, the individual legal provisions of the User’s country are not considered.

By using or accessing our Service, you understand and accept these Terms.

Fee Changes

Ailo sp. z o.o., in its sole discretion and at any time, may modify the Subscription fees for the Subscriptions. Any Subscription fee change will become effective at the end of the then-current Billing Cycle.

Ailo sp. z o.o. will provide you with reasonable prior notice of any change in Subscription fees to allow you to terminate your Subscription before such change becomes effective.

Your continued use of the Service after the Subscription fee change comes into effect constitutes your agreement to pay the modified Subscription fee amount.

By using or accessing our Service, you understand and accept these Terms.


If Subscription fees are challenged at a company that supports your credit card or your financial institution, and if the Ailo investigation leads to the conclusion that the fees were justified, we may, with reasonable notice in advance, charge your Account a justified amount required to represent the cost of responding to your chargeback Refund request.

By using or accessing our Service, you understand and accept these Terms.

Invoices and confirmations

We do not issue manual Invoices at the Customer’s request.

IQ Hashtags Invoices are issued automatically based on the Customer’s company data entered.

Entering data for invoicing is mandatory for people who want to receive an Invoice for their purchase.

In the case of New Users starting the Trial Period in the tool, the User is obliged to complete the data required to issue an Invoice within 7 days from the start of the Trial Period in the Account Settings in the Subscription section.

Users for whom the Trial Period does not apply (who have used paid Plans in the past and/or are renewing the Subscription) are required to fill in the data immediately in the process of making Payment for the Subscription.

Customers who have yet to enter their company details within the specified time will receive an automatic Invoice in the tool without their company details.

The automatic Invoice also confirms the purchase in the tool; no other confirmation is required.

Other situations will be considered individually after sending a request to [email protected], provided that the time from the Payment to the application does not exceed 1 month.

By using or accessing our Service, you understand and accept these Terms.

Marketing & Newsletter

By Registering an Account with IQhashtags, you agree to receive emails, including newsletters, product updates, start-up news, invitations to webinars, or any other messages we deem relevant and important.

You may unsubscribe from any of these by using the “Unsubscribe” button in each message.

You agree that the deletion of your Account and data from the Service or the termination of your Subscription to the Service does not imply the termination of the marketing agreement.

Therefore, you agree to receive messages even if you have deleted or terminated your Account and Subscription.

Suppose you no longer consent to receive emails from IQ Hashtags. 

In that case, you are responsible for removing yourself from this mailing list by clicking the “Unsubscribe” button in the email you receive and agreeing to do so yourself.

By using or accessing our Service, you understand and accept these Terms.

Governing Law

These Terms shall be governed and construed in accordance with the laws of Poland, without regard to its conflict of law provisions.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect.

These Terms constitute the entire agreement between us regarding our Service and supersede and replace any prior agreements we have between us regarding the Service.

According to Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on the online consumer dispute resolution system and amendments to Regulation (EC) No 2006/2004 and Directive 2009/22 / EC (Regulation on the ODR in consumer disputes).

The Ailo, an entrepreneur-registered office in the Union concluding internet sales or service contracts, provides an electronic link to the ODR (Online Dispute Resolution) platform enabling out-of-court dispute resolution: http://ec.europa.eu/consumers/odr/. By registering on the website, you confirm that you have read the entire Terms of Service and agree to all the above rules.

Ignorance of these terms does not exempt you from complying with them and from responsibility for your actions and decisions.
